1. Parties to the contract

The following Terms & Conditions (TC) regulate the contractual relationship and form an integral part of the contract between FlyTicino, on the one hand, and the Customer, on the other.

 

2. Object of the contract

The object of the contract is the reservation of a tandem paragliding flight (from now on “activity”) with FlyTicino by the Customer. For contractual purposes, the data entered by the Customer in the booking form shall be held binding.

 

3. Conclusion of the contract

The contract is concluded through the Customer submitting the booking form, together with the payment by credit card of a booking deposit. The amount of the deposit is agreed unequivocally between the parties, in writing, on WhatsApp or via E-mail. By paying the deposit, the Customer acknowledges having read, understood and accepted, without reservation, the TC.

 

4. Cancellation of the reservation by FlyTicino

After the conclusion of the contract, FlyTicino has the right to cancel a reservation at any time if it considers that the weather conditions or the state of health of the passenger do not allow the safe conduct of the activity. In this case FlyTicino undertakes to refund the Customer the entire deposit received by him at the time of booking. The Customer cannot request further damages to FlyTicino.

 

5. Cancellation of the reservation by the Customer

The Customer can cancel his reservation without the obligation of a justification. In this case, he must send a cancellation request to FlyTicino via WhatsApp at +41 79 796 76 18 or via e-mail at info@flyticino.ch. The request must reach FlyTicino no later than 15 days before the date agreed for the activity. In this case FlyTicino undertakes to refund the Customer the entire deposit received by him at the time of booking.

 

6. Cancellation fees after the deadline

Any cancellation of the reservation by the customer outside the period indicated in point 5, including no-show or arrival to the meeting point with a delay of more than 15 minutes, entitles FlyTicino a cancellation penalty of:

  • 50% of the booking deposit, from 14 to 7 days before the date agreed for activity
  • 100% of the booking deposit, less than 7 days before the date agreed for the activity

The penalty is collected regardless of the reasons for the cancellation (force majeure included).

 

7. Jurisdiction and applicable law

The TC are governed by Swiss law, excluding its private international law rules. The place of jurisdiction is Lugano, subject to appeal to the Federal Court.
