1. Parts and object of the contract

The following Terms & Conditions (TC) regulate the contractual relationship – and form an integral part of the contract – between FlyTicino, on the one hand, and the Customer, on the other. The object of the contract is the reservation by the Customer of a tandem paragliding flight with FlyTicino. For the reservation, the data entered by the Customer in the booking form on this page, sent together with the payment of the deposit by credit card, shall be held binding.

2. Contract conclusion

The contract is concluded with the Customer submitting the reservation form on this page, together with the credit card payment of the deposit. With the payment of the deposit, the customer acknowledges having read, understood and accepted, without any reservation, the TC. In case of disagreement with the TC, the Customer refrains from making the payment of the deposit.

3. Reservation amount

To confirm the reservation of a tandem paragliding flight, FlyTicino requires the customer to pay a guarantee deposit, equivalent to 50% of the total price of the service agreed between the parties. Said amount is communicated unequivocally by FlyTicino to the Customer in writing via WhatsApp or via email.

4. Right of withdrawal by FlyTicino

Following the completion of the contract, FlyTicino has the right to cancel a reservation at any time if it considers that the weather conditions or the state of the passenger do not allow the safe operation of the activity. In this case FlyTicino commits to reimburse the Customer within 14 days for the full amount of the guarantee deposit received from them at the time of booking. The Customer can not request further compensation from FlyTicino.

5. Reservation cancellation by the Customer

The Customer can cancel his/her reservation without the obligation of a justification. In this case he/she must send the cancellation request to FlyTicino via WhatsApp at +41 79 796 76 18 or via email at info@flyticino.ch clearly mentioning the intention to cancel the reservation. The request must arrive at FlyTicino no later than 14 days before the scheduled date of the activity.

6. Cancellation fees after expiry date

Any cancellation of the reservation by the Customer outside the period of time referred to in paragraph 5 (including no-show or arrival with a delay of more than 15 minutes), regardless of the reasons (force majeure included), implies a cancellation penalty of:

  • 50% of the guarantee deposit from 13 to 7 days before the scheduled date of the activity;
  • 100% of the guarantee deposit less than 7 days before the scheduled date of the activity.

7. Jurisdiction and applicable law

The TC are governed by Swiss law, excluding its rules of private international law. The competent court is Lugano (Switzerland), subject to appeal to the Federal Court.

8. Modification of the Terms and Conditions

FlyTicino reserves the right to modify the TC at any time and without notice, by publishing a new version of the TC on the Website (which cancels and replaces the previous version). Any booking made after the publication by FlyTicino of a new version of the TC implies acceptance of this new version.
